If users desire a review or deletion of personal information that Visionary stores, they must contact the Privacy Czar (contact information is stated earlier in this statement) with specific requests.

Premise of Information Gathering Practices

Visionary collects information at ToeShades primarily to enhance the enjoyment of its users. These users desire activities such as:

Free eMail
Site Personalization
Contests
Polls
eZines (eMail based newsletters)
Forums
… etc.

Visionary can only provide these activities by obtaining certain types of information from participating users. For minimal activities (such as Polls, eZines, and Forums) only age, name, and an eMail address are required for user participation (although other information may be requested). For more extensive activities (such as free eMail and Contests) age, name, Zip Code, gender, and other types of information are required for user participation.

How Information Is Used

Visionary uses the information it collects for a variety of activities. These activities include eMail authentication, user polling, contest fulfillment, and other activities designed to enhance the quality of ToeShades.

Information Disclosure

VISIONARY NEVER DISCLOSES PERSONALLY IDENTIFIABLE INFORMATION TO THE GENERAL PUBLIC WITHOUT SPECIFIC PERMISSION FROM THE UNIQUE USER OR INSTRUCTED TO BY GOVERNMENT OR LAW ENFORCEMENT AUTHORITIES. Additionally, Visionary never discloses any non-aggregate information to any commercial third party unless agreed to by the unique user through a special request (as addressed in the Users Above The Age of 13 section of this statement), a special Opt-It statement (located on the actual information entry form specifying the identity of the third party and intent of use), a special agreement (such as the terms of use for the Free eMail), and other such circumstances. All of the information collected at ToeShades is stored in databases exclusively controlled by Visionary. Complete and meaningful access to this data is restricted within Visionary to a small set of executives.

User Responsibility

If a user does not want to share information with Visionary, it is strongly recommended that they not participate in any activity that requires them to fill out a form. If the user has submitted information and then requested that it be removed from all Visionary databases, then that user is responsible for the determination of whether his/her information can be resubmitted at ToeShades. Visionary will delete information in its databases, but will not proactively screen for users above the age of 13 years. The majority of the ToeShades site is meant to be used without the disclosure of any personally identifiable information. Small sets of data (cookies) may be placed on the systems of anonymous and known users for traffic analysis and usage enhancements. No personal information is included in this data. If a user wishes to avoid these cookies, they can alter their Internet software accordingly, most of the YGen site will still be available in these circumstances.

External Parties

ToeShades is a commercial Internet site that operates, in part, from merchandise sales revenues and joint promotional activities. Visionary has taken several measures to differentiate ToeShades from promotional partners. This statement does not cover the conduct or methods of displayed advertisers and/or external partners. Visionary in no way accepts responsibility for the actions, events, or conduct of external parties.

Updates To This Statement

Visionary reserves the right to alter, or update, this statement as is reasonable in the course of conducting pertinent operational activities. All users who have submitted personal information will be notified of changes to this statement within 48 hours of the time it goes into effect.
